近期国家能源局发布了《关于能源领域深化“放管服”改革优化营商环境的实施意见(征求意见稿)》意见的公告,其中提到创新推动能源低碳转型:
(一)促进新能源加速发展
简化新能源项目备案手续,无补贴新能源项目实施无条件备案。对于依法依规已履行行政许可手续的项目,不得针对项目开工建设、并网运行及竣工验收等环节增加或变相增加办理环节和申请材料。鼓励地方政府探索借鉴“标准地”改革方式,为新建能源项目先行完成一些基础性评价、审批等工作,为项目打好前期基础,提高能源项目开工效率。电网企业要支持实施清洁替代、自发自用的新能源发电项目并网。
(二)推进多能互补一体化发展
建立清洁能源基地多能源品种协同开发机制,统筹开发主体,建立完善多能互补一体化规划、一体化审批(或备案)、一体化建设流程,统筹多能互补项目与输电通道建设时序。
(三)推动分布式发电市场建设
完善分布式发电市场化交易机制,完善支持分布式发电市场化交易的价格政策,建立适应可再生能源微电网、存量小电网、增量配电网与大电网开展交易的体制机制,推动“隔墙售电”工作落地。
(四)建立健全能源低碳转型的长效机制
支持煤炭、油气等企业利用现有资源建设光伏等清洁能源发电项目,推动天然气发电与可再生能源融合发展项目落地,促进化石能源与可再生能源协同发展。适应以新能源为主体的新型电力系统建设,促进煤电与新能源发展更好的协同。进一步鼓励并优化能源企业与主要用户间的长期协议机制,保障能源稳定供应。
(五)探索包容审慎监管新方式
对综合能源服务、智慧能源、储能等新产业新业态,在严守安全、环保规范标准的基础上,探索“监管沙盒”的方式,鼓励开展政策和机制创新。建立与新兴市场主体间的良性沟通互动机制,在实践中探索寓监管于服务的有效方式。

关于能源领域深化“放管服”改革优化营商环境的实施意见(征求意见稿 )
一、持续深化行政审批制度改革
(一)推行能源领域“证照分离”改革全覆盖
在全国范围内深化能源领域“证照分离”改革,大力推动照后减证和简化审批。按照全覆盖要求,将全部涉企经营许可事项纳入清单管理,按照直接取消审批、审批改为备案、实行告知承诺、优化审批服务等四种方式分类推进审批制度改革,逐项确定具体改革举措,建立简约高效、公正透明、宽进严管的行业准营规则,提高能源市场主体办事的便利度和可预期性。
(二)优化涉企审批服务
清理规范能源领域行政审批前置条件和审批标准,明确行政备案材料、程序,依托全国一体化政务服务平台,推动更多能源领域涉企事项网上办理,大力推进减环节、减材料、减时限、减费用,降低制度性交易成本。精简整合能源项目投资建设审批流程,在确保工程质量和安全前提下,进一步清理规范项目审批全流程涉及的行政许可、技术审查等事项,让项目早落地、早投产。加强项目立项与用地、规划等建设条件衔接。推动项目在线审批监管平台和各相关审批系统互联互通和数据共享,避免企业重复填报、部门重复核验。
(三)推行许可告知承诺制
推行能源领域许可告知承诺制,全面推行电力业务、承装(修、试)电力设施等许可事项实行告知承诺制。依法列出可量化、可操作、不含兜底条款的许可条件,明确适用对象、监管规则和违反承诺后果,一次性告知企业。实行告知承诺后,对因企业承诺可以减省的审批材料,不再要求企业提供。对企业自愿作出承诺并按要求提交材料的,要当场作出审批决定。对通过告知承诺取得许可的企业,要加强事中事后监管,确有必要的可以开展全覆盖核查。发现企业不符合许可条件的,依法调查处理,并将失信违法行为记入企业信用记录,依法依规实施失信惩戒,将企业履行承诺情况纳入信用记录,并归集至全国信用信息共享平台。
(四)加大简政放权改革试点力度
自由贸易试验区、行政备案规范管理改革试点等具备条件的地区,进一步加大能源领域简政放权改革试点力度,为全国能源领域简政放权改革积累可复制可推广的经验。
二、切实加强能源领域科学监管
(一)加快完善能源监管体系
明确监管职责,按照“谁审批、谁监管,谁主管、谁监管”原则,严格落实法律法规和“三定”明确的能源监管职责。健全监管规则,及时查找监管漏洞,加快制定、修订、更新监管法规文件。加强事中事后监管,各级能源管理部门要针对2013年以来取消、下放的行政许可事项,分析查找存在的风险隐患和监管漏洞,创新和加强事中事后监管,探索完善随机抽查等监管办法,切实提高监管效能。
(二)持续加强能源市场秩序监管
区分竞争性和垄断性环节,推动能源领域的自然垄断性业务和竞争性业务分离。推动落实电网企业功能定位,进一步深化主辅分离、厂网分离,建立电网企业竞争性业务年度报告机制。加强竞争性环节市场秩序监管,着力构建主体多元、竞争有序的市场格局。加强市场运营机构监管,针对市场运营机构的交易组织、公告发布、结果出清、信息披露等环节出具监管报告,保证市场运营过程的公开透明。实施阳光监管,健全并公开监管标准,压缩监管执法的弹性空间,实现科学监管、精准监管,切实推动有关单位及时、规范、详尽地披露市场信息。
(三)全面实施“双随机、一公开”监管
完善随机抽查机制和抽查事项清单,明确检查重点、检查方法和工作要求。依据信用风险高低实施分级分类监管,提高高风险市场主体抽查比例和频次,增强监管的精准性和威慑力。
(四)健全完善信用监管
扎实做好能源行业信用信息归集共享、行业公共信用评价、信用风险分析预警等工作,完善信用承诺、失信约束、信用修复等信用监管制度及措施。在行政许可、行政审批、产能替代、财政性资金补贴、新能源并网接入、电力市场交易、油气管网公平开放、电力工程建设等重点监管领域,结合“双随机、一公开”监管,强化运用信用分级分类差异化监管措施。积极构建“以信用为基础、贯穿市场主体全生命周期,衔接事前、事中、事后全监管环节”的新型能源监管机制,多方协同大力提升能源监管的精准性、有效性。
(五)大力推行“互联网+监管”
加快推进线上线下一体化监管,推动实现能源监管事项一体化、数据支撑一体化、业务协同一体化、运营管理一体化、安全保障一体化。加强能源监管领域数据汇集,进一步完善“互联网+监管”系统风险预警模型,形成风险预警线索推送、处置和反馈机制,提升能源监管智能化水平。完善“互联网+监管”系统功能、优化提升支撑能力,围绕行政许可、行业规划、项目审批、市场运营、安全管控等能源行业重点监管业务需求,开发完善配套功能,进一步加大政务信息资源的共享力度。
(六)积极探索提高协同监管能力
结合能源行业监管需要建立条块结合、区域联动、信息共享、协同高效的监管机制。在能源领域建立跨部门综合监管机制,减少执法扰民,提升监管效能。加强行政执法与刑事司法衔接,建立健全案情通报、案件移送和联合调查机制。
三、推进政务服务标准化规范化便利化
(一)推进政务服务事项实施清单标准化
明确能源领域的政务服务事项拆分标准,在“四级四同”基础上,推动逐步实现同一能源领域政务服务事项受理条件、办理流程、所需材料、法定办结时限、办理结果等要素在全国范围统一,形成政务服务事项实施清单。对于各地区依法依规自行设立的地方能源领域政务服务事项,各地方能源管理部门要做好实施清单要素统一工作。
(二)规范审批服务行为
推进审批服务事项依法依规办理,严格按照能源领域审批服务事项实施清单提供办事服务,公开事项办理流程和条件标准等信息。各级能源管理部门及能源监管机构不得在法定条件之外增加前置条件。严格执行首问负责、一次告知和限时办结等制度。优化前置服务,加强审批前申报辅导。建立现场勘验、技术审查、听证论证等程序限时办结机制。各级能源管理部门及能源监管机构要及时监管并披露相关项目审批服务规范落实情况。
(三)规范中介服务
进一步清理能源领域政务服务无法定依据的中介服务事项,对确需保留的强制性中介服务事项,实行目录清单管理并及时向社会公布。各级能源管理部门不得强制企业选择特定中介服务机构。加强对中介服务机构的信用监管,实行信用等级评价、资质动态管理,解决中介服务环节多、耗时长、市场垄断、红顶中介等问题。
(四)推进政务服务便利化
从企业和群众办事角度出发,集成能源领域内部关联性强、办事频度高、企业群众获得感强的事项,提供主题式、套餐式服务。按照“一次告知、一表申请、一套材料、一窗受理、一网办理、一口发证”要求,优化再造业务办理流程,通过系统对接整合和数据共享,减少办事环节、精简办事材料、压缩办理时限。加快推进电子证照在能源领域政务服务中应用,能够通过数据共享获得的信息,不得要求办事人提供实体证照。
(五)推行政务服务“告知承诺”“容缺受理”制度
除涉及公共安全、生态环境保护、节约能源等政务服务事项外,各级能源管理部门及能源监管机构按照最大原则梳理采取告知承诺的事项清单,明确承诺的具体内容、要求和违反承诺应承担的法律责任,细化网上办事承诺方式和承诺事项监管细则,及时向社会公布。完善容缺受理服务机制,各级能源管理部门及监管机构依法编制公布容缺受理能源领域政务服务事项清单,明确事项名称、主要申请材料和可容缺受理材料。
(六)做好政务服务评价
落实政务服务“好差评”制度,全面开展“好差评”工作。坚持评价人自愿自主评价原则,不得强迫或干扰评价人的评价行为,更好发挥社会监督作用,及时回应社会关切。
四、优化营商环境培育和激发市场主体活力
(一)全面提升“获得电力”服务水平
各省级能源管理部门要按照《国家发展改革委 国家能源局关于全面提升“获得电力”服务水平优化用电营商环境的通知》(发改能源规〔2020〕1479号)制定本省区全面提升“获得电力”服务水平三年行动方案和任务台账,并按照有关要求持续抓好落实,压减办电时间,提高办电透明度和便利度,降低办电成本,全面推广低压小微企业用电报装“零上门、零审批、零投资”服务、高压用户用电报装“省力、省时、省钱”服务等典型经验做法。供电企业要防范和杜绝用户受电工程“三指定”行为。各能源监管机构要加大监管力度,强化日常监管,压实供电企业落实主体责任,着力补齐服务短板和工作弱项,督促相关省级能源管理部门履行好牵头责任。
(二)提升供电质量
供电企业要加强用户供电质量管理,大力推广不停电作业,有效压减电力用户停电时间、次数和影响范围,提升配电网电能质量,加大频繁停电、低电压、用户故障出门等问题的整治力度。各省级能源管理部门、国家能源局派出机构要结合乡村振兴战略、电网升级改造等工作,加强供电可靠性、电压合格率等供电质量主要指标的日常监管,保障安全、稳定的电力供应质量。
(三)规范接网服务
电网企业要做好新能源、分布式能源、新型储能、微电网和增量配电网等项目接入电网服务。电网企业应提供配变可开放容量的信息查询入口,实现接入电网可开放容量信息公开。优化基本流程和协调机制,明确接网申请受理、方案答复等环节办理时限,提高接网审批效率。电网企业制定完善电源接网审查技术标准,制定标准化收资清单和服务要求,规范接网审批的自由裁量权。签订接网协议,规范电网和接网企业的权利和义务,明确接网工程建设时间,明确新能源投资企业自建配套送出工程的回购标准。探索建立由第三方机构承担接入系统审查工作的机制,经有关政府部门或监管部门备案后即可接入。建立电网接入完成率评价机制,将电网接入完成率作为电网投资有效性评价和电网企业落实可再生能源消纳责任的重要指标。
油气管网设施运营企业要做好下游用户支线项目开口服务,明确开口申请受理条件及评审、审批等环节办理时限,简化办理环节、压缩办理时间,提高开口审批效率。
(四)切实维护公平竞争的市场秩序
对包括国企、民企、外企在内的各类市场主体一视同仁,对垄断和不正当竞争进行规范治理。加强公平竞争审查,梳理并剖析妨碍统一市场和公平竞争的典型问题,增强针对性和有效性,深入推进实质性审查。任何部门和单位不得干预市场主体的合法交易行为以及市场价格,不搞专场交易、破除行政壁垒,鼓励市场主体参与跨省跨区交易。
(五)督促能源企业依法依规招投标
提升能源领域招投标透明度和规范性,督促电网企业、管网企业更加重视招投标管理,完善制度、信息公开,防范不公平竞争。持续推进招投标全流程电子化,推动能源领域评标专家资源互联共享。
(六)进一步清理证明事项
对部门规章、规范性文件设定的能源领域证明事项进行全面清理,实现清单管理。各级能源管理部门办理依申请的行政事项不得索要清单之外的证明。
(七)重视市场主体合理诉求

各级能源管理部门及能源监管机构要直面市场主体需求,围绕市场主体关切,科学精准实施能源政策措施。健全企业合理诉求解决机制,完善问题受理、协同办理、结果反馈等流程,杜绝投诉无门、推诿扯皮现象,有效解决企业面临的实际困难问题。针对企业和群众反映的涉及营商环境事项,认真调查处理,不得将重要投诉举报线索移交被投诉举报的主体处理,抓典型,定期通报,以点带面,促进从制度层面整改,优化营商环境。鼓励通过电话回访、问卷调查等方式,及时掌握投诉举报反映的问题,重点加以解决。
(八)严格规范公正文明执法
对能源领域中现行行政法规、规章设定的罚款事项进行全面梳理,取消或调整不合理罚款事项。公平公正处理行政复议案件,依法依规处理行政应诉案件,纠正执法不严、简单粗暴、畸轻畸重等行为。加强执法监督,规范行政执法行为。
五、创新推动能源低碳转型
(一)促进新能源加速发展

六、组织实施
(一)加强组织协调。各级能源管理部门、能源监管机构要高度重视,提高认识,各司其职,形成合力。国家能源局要加强对各级能源管理部门、能源监管机构的指导督促,确保改革举措落实到位。
(二)抓好责任落实。各单位要切实负起责任,按照本意见提出的各项措施和要求,抓实抓细相关改革,切实做到放出活力、管出公平、服出效率。
(三)强化评估总结。密切跟踪改革进展,及时总结经验,为深化“放管服”改革优化营商环境积累可复制可推广的创新做法和经验。

Establish the cooperative development mechanism of multiple energy varieties in the clean energy base, coordinate the development subjects, establish and improve the integrated planning, approval (or filing) and construction process of multi-energy complementarity, and coordinate the construction sequence of multi-energy complementarity projects and transmission channels.

(3) Promoting the construction of the distributed power generation market

We will improve the market-based trading mechanism for distributed power generation, improve pricing policies to support market-based trading of distributed power generation, establish systems and mechanisms to accommodate transactions between renewable energy microgrids, small stock grids, incremental distribution grids and large grids, and promote the implementation of "electricity sales through walls".

4. Establish and improve a long-term mechanism for low-carbon energy transition

We will support coal, oil and gas enterprises in developing photovoltaic and other clean energy power generation projects using existing resources, promote the implementation of projects to integrate natural gas power generation with renewable energy, and promote the coordinated development of fossil energy and renewable energy. Adapt to the construction of new power system with new energy as the main body, and promote better coordination between coal power and new energy development. We will further encourage and optimize long-term agreement mechanisms between energy enterprises and major users to ensure stable energy supply.

5. Exploring new ways of accommodating prudential regulation

For new industries and forms of business, such as integrated energy services, smart energy and energy storage, we will explore a "sandbox" approach to regulation while strictly observing safety and environmental protection standards, and encourage policy and institutional innovation. We will establish a sound communication and interaction mechanism with emerging market entities, and explore effective ways to combine regulation with service in practice.

We will improve regulatory rules, promptly identify regulatory loopholes, and accelerate the formulation, revision, and updating of regulatory documents. Energy administrative departments at all levels should analyze and identify potential risks and regulatory loopholes for administrative licensing items that have been canceled or delegated to lower-level governments since 2013, innovate and strengthen in-process and post-process oversight, explore and improve random sampling and other regulatory methods, and effectively improve the effectiveness of oversight.

2. We will continue to strengthen orderly regulation of the energy market

Distinguish between competitive and monopolistic sectors, and promote the separation of natural monopolistic businesses and competitive businesses in the energy sector. We will promote the implementation of the functional positioning of power grid enterprises, further deepen the separation of primary and secondary enterprises and the separation of plant and network, and establish an annual reporting mechanism for the competitive business of power grid enterprises.We will strengthen regulation of competitive markets, and strive to build a market with multiple entities and orderly competition. We will strengthen supervision over market operation institutions and issue regulatory reports on the trading organization, announcement release, result clearing and information disclosure of market operation institutions to ensure the openness and transparency of the market operation process.We will implement transparent oversight, improve and make public regulatory standards, reduce the flexibility for oversight and law enforcement, implement scientific and precise oversight, and encourage relevant units to disclose market information in a timely, standardized and detailed manner.
